These Terms and Conditions govern your use of our website, mobile application, and services (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms and Conditions.

"FyahChef", "we", "us", or "our" refers to FyahChef Inc., the company operating this Platform.

"User", "you", or "your" refers to any individual or entity that accesses or uses our Platform.

"Chef" refers to any individual or entity that offers food preparation and delivery services through our Platform.

"Customer" refers to any individual or entity that orders food through our Platform.

3. Account Registration

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Chef Services

Chefs on our Platform are independent contractors and not employees of FyahChef. We do not guarantee the quality, safety, or legality of any food or services provided by Chefs.

Chefs are responsible for complying with all applicable laws and regulations regarding food preparation, handling, and delivery, including obtaining any necessary licenses or permits.

5. Ordering and Payment

When placing an order, you agree to pay the full amount specified, including the cost of food, delivery fees, service fees, and applicable taxes.

Payment processing services are provided by third-party payment processors, and you agree to comply with their terms and conditions.

6. Cancellations and Refunds

Cancellation and refund policies may vary depending on the Chef and the circumstances. Generally, orders may be cancelled for a full refund if the Chef has not yet started preparing the food.

If you are dissatisfied with your order, please contact us within 24 hours of delivery, and we will work with you to resolve the issue.

7. Intellectual Property

All content on our Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of FyahChef or its content suppliers and is protected by international copyright laws.

8. User Content

By submitting content to our Platform (including reviews, photos, and comments), you grant FyahChef a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

9. Prohibited Activities

You agree not to:

• Use our Platform for any illegal purpose or in violation of any local, state, national, or international law
• Violate or encourage others to violate the rights of third parties, including intellectual property rights
• Post or transmit any content that is unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable
• Attempt to gain unauthorized access to our Platform, other users' accounts, or computer systems

10. Limitation of Liability

To the maximum extent permitted by law, FyahChef shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use our Platform
• Any conduct or content of any third party on our Platform, including Chefs
• Any content obtained from our Platform
• Unauthorized access, use, or alteration of your transmissions or content

11. Indemnification

You agree to indemnify, defend, and hold harmless FyahChef, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of our Platform.

12. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. If we make material changes, we will notify you by email or by posting a notice on our Platform prior to the changes becoming effective.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

14. Dispute Resolution
